Terms of Service

1. Entity and Jurisdiction

These terms apply to The DIGIT and are interpreted alongside the signed proposal, statement of work, or service agreement for each client engagement. Unless a signed agreement states otherwise, the configured operating jurisdiction is Pakistan.

2. The Services We Provide

The DIGIT is a high-performance development studio specializing in SaaS, AI automation, and full-stack software architecture. Our services involve bespoke strategy, software asset creation, and API integration. Deliverables, timelines, and specific contractual boundaries remain subject to the individual Statements of Work (SOW) executed separately between The DIGIT and the respective Client.

3. Statements of Work, Timelines, and Acceptance

Project scope, milestones, deliverables, dependencies, payment schedule, support period, and acceptance criteria are defined in the applicable statement of work. Timeline estimates assume timely access to required accounts, content, feedback, data, and third-party approvals.

4. Intellectual Property Rights

Once a project is completed and fully paid for, all associated Intellectual Property Rights pertaining strictly to the custom deliverables built natively for the Client are transferred to the Client. The DIGIT reserves the right to retain underlying open-source methodologies, framework logic, and proprietary code generators or scaffolding modules used consistently across multiple systems unless explicitly restricted via bespoke licensing.

5. Security, Accounts, and Client Responsibilities

Clients are responsible for providing accurate information, maintaining access to their own third-party accounts, protecting credentials, and reviewing deliverables in a timely way. We use reasonable safeguards, but no internet-connected system can be guaranteed to be completely risk-free.

6. Disclaimer of Warranties

All architectural proposals, software implementations, and consulting solutions are provided "as is" and "as available". To the extent permitted by law, The DIGIT explicitly disclaims all warranties regarding an application's implied merchantability or absolute fitness for a constantly evolving third-party ecosystem (such as unannounced breaking changes in third-party APIs beyond our control).

7. Liability Limitations

The DIGIT shall not be liable for any indirect, incidental, consequential, special, or exemplary damages arising out of or in connection with your access or use of our services, business interruptions, loss of profits, or data corruption occurring post-deployment. We build with strict Quality Assurance but operate under the inherent realities of dynamic software systems.

8. Termination

We may terminate or suspend access to our proprietary environments immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Revisions to these Terms

The DIGIT reserves the right to revise these Terms at any time as it sees fit. By continually using our services, you are expected to review these terms on a regular basis to assure your rigorous compliance.
